TERMS OF SERVICE

Definitions
We”, “our”, “ourselves” and “us” means Mohican.biz

“You”, “your” and “yourself” means any person or company, participating in our website, either as employer or freelancer.

“Employer” refers to a member registered and or participating on our website, posting, awarding and paying for jobs.

“Freelancer” refers to a member registered and or participating on our website, viewing, and bidding for jobs posted.

“Job” means a particular work an Employer wished to have done.

Platform Policies

1. Behavior on the website
Participants are expected to be cordial in their communications. Insults and abuses of any kind will not be tolerated and can lead to suspension or outright termination of the account.

You are not allowed to make public any posts or content from any of the data depicted on our site.Spam will not be accepted in any form.

2. Site Content
You will not post projects, messages or content on the website about:

  • pornography and content unsuitable for minors,
  • violent content,
  • content related to racial intolerance or attacks on a particular group or organization,
  • content that includes excessive profanity,
  • content related to hacking,
  • content related to casinos and gambling,
  • drug-related content and related articles,
  • content related to the sale of products that are replicas or imitations of designer goods and other items,
  • malicious software (viruses, spyware, etc.),
  • or any other content that is illegal, promotes illegal activity or infringes the legal rights of others.

3. Policies for the publication and posting of jobs
If a job is in violation of any of our website’s policies, it will be removed from the website. It will be at our sole discretion to allow re-publish of the work if the violation is corrected.

The most common reasons for the removal of work ads on our website are:

  • It violates the terms of service of another company or entity.
  • It asks vendors for unpaid work.
  • The content violates section 2 of these policies.
  • Payment is offered outside our website's payment platform.
  • Payment is based on commission or compensation in shares.
  • It violates the integrity of an academic institution, including homework, writing essays for school, exams or submitting applications.
  • It violates any U.S. laws or laws from any other country.
  • It should not contain personal or contact information.
  • It should not promote other services or products.
  • It should not be used to find full-time employees.

3.1 Publishing Guide Project by Employers
     
- The needs and skills required to complete the project must be clear.

- It must be written properly and completely.

- You must answer workers' questions and update the job description.

- Only accept proposals when you have a clear job description, well-defined milestones, exact timing and payment terms.

- Evaluate multiple proposals based on criteria that are important to you, experience as a worker, education, portfolio, certifications, references, feedback from previous Employers, location, communication, style and cost.

- Ask the worker to establish the conditions, define milestones and payments.

- Ask about the worker's office hours and about their standard response times.

- Once you have hired someone for your project, log in to the site to manage their work.

4. Policies for Proposals
When submitting a proposal, the provider may not:

  • Offer their services for free.
  • Use unprofessional language and/or harass another member of our website.
  • Offer to get paid outside our website.
  • Use messaging and proposals for other purposes instead of presenting a proposal.

Include any contact information. For example: Skype, email, phone, website URL, GTalk, etc.

4.1 Guide to send in proposals by freelancers
As a worker, you agree to follow these guidelines when submitting a proposal:

  • Send proposals only for jobs for which you are a good option and are qualified to complete according to the deadline established by the Employer.
  • Help the Employer clarify their needs and fully develop the scope of work and deliverables.
  • Write a concrete and detailed proposal with clear scope, deliverables and milestones.
  • Set expectations that you can meet or exceed.
  • Specify the payment terms that are linked to the achievement of milestones
  • Specify how requests for changes and revisions will be handled.
  • Specify how the work guarantee will be handled.
  • Submit a proposal accurately to reflect your understanding of the scope of work and of the amount of time / effort that you will dedicate in order to achieve customer satisfaction.
  • Inform your Employer about your office hours and established response time.
  • Submit a proposal again when necessary to reflect any changes in price, delivery date or approach, before the end of the period of proposal.
  • Do not submit unreasonably low prices or "experimental" proposal or proposals. If you want to submit a proposal, but are in need of more information about the job, send a message to request more information, stating your assumptions about the scope of work on your proposal and explicit that the proposal will be updated once you receive more information.
  • Do not send proposals with the intent to commit fraud.
  • Do not present repetitive content or generic proposals.
  • Do not offer your services in exchange for good feedback or for free.
  • Agree with the Employer on an Independent Contractor Agreement and upload it to your workroom. This agreement will rule the execution of the work to be done.

5. Policies for posting your profile on your microsite
  A microsite will be automatically created for each freelancer, pulling the information from the freelancer’s dashboard. The information contained will be   some mandatory and some optional. On the microsite the freelancer will appear with a screen identity, not the real name of the freelancer.

A worker's profile cannot contain:

  • Contact information beyond what is offered on your microsite.
  • Offers for payments outside our website's payment platform.
  • Offers for free services.
  • Offers for services that are against our website's Terms & Conditions.
  • Any text that is copied from another worker profile.
  • Display of work over which the profile owner has no legal rights or property.

6. Penalties for violation of a Policy
At its sole discretion, our website will suspend or terminate the accounts of members who violate its policies.

Publication violations offering jobs/projects, will be removed from the site. Repeated violations of our policies will result in account termination.

For workers' violations, the minimum penalty is a suspension of ten days. For major violations, such as plagiarism, avoiding fee payments, manipulating comments or repeated violations of our policies, the worker's account is subject to immediate termination.
